Terms of Service.
Content and consent rules
Use Phosphene for original or stylised characters, consistent characters across shots, or your self-depiction with documented consent. These rules apply to prompts, reference files, training data and generated images, videos and audio.
No face-swapping, deepfakes or impersonating real people without consent; no voice cloning of others.
Do not replace one person's face with another or create misleading synthetic media. Any depiction of a real, identifiable person requires documented consent for the specific use; keep that record and provide it on request. Possessing a photo or recording is not consent. Non-consensual content and sexual content depicting an identifiable individual are prohibited, even with consent.
Violations may result in termination of your Pro or Founding licence without refund, to the extent permitted by law. Mandatory consumer rights remain unaffected. Report abuse through our contact page.
Who we are
Phosphene, operated by Mr Bizarro (independent developer, Israel).
These terms cover this website and the paid plans when they launch. By using the website or buying a plan, you agree to these terms. The open-source app remains under the MIT licence.
What Phosphene does
Phosphene is a free, open-source Mac app for Apple Silicon. It runs open AI models locally to make video with sound, songs and images. You download the models yourself and accept each model's own licence. Some models are for non-commercial use only, as labelled in the app. A paid plan does not change a model's licence or give you extra rights to its outputs.
Free and paid plans
The open-source app is free. Paid plans are coming soon and are not on sale yet. Features, plans and prices may change; the price you pay is the one shown at checkout. See pricing for the current plans.
Your licence
A paid licence is personal, non-transferable and works on a limited number of Macs, as described at purchase. Do not share, resell or transfer your licence key. You must not reverse engineer proprietary paid components, except where the law permits it. This does not apply to the open-source parts, which remain under MIT.
Acceptable use and your outputs
- Follow the law and each model's licence, including any limits on commercial use.
- Do not create or distribute illegal content.
- Follow the content and consent rules above and the Acceptable Use Policy.
- Do not falsely represent yourself as another individual or organisation.
You are responsible for what you input, generate, use and share, including having the necessary rights and permissions. Review outputs before using them.
Payments, renewals and refunds
Payments are processed by our payment provider, Whop, and Whop's terms also apply to your order. Subscriptions renew until cancelled. You can cancel at any time and keep access until the end of the paid period. Founding is a one-time purchase that covers 3 years of Pro with no renewal. Your first purchase has a 14-day refund window; see the refund and cancellation policy. Taxes may be added at checkout depending on where you live.
Privacy
Our Privacy Policy explains how we handle data.
No warranty
To the extent the law allows, Phosphene is provided “as is”, without warranties. We do not promise error-free operation, a particular result or that generated content will be accurate or suitable for your purpose.
Limits on liability
To the extent the law allows, we are not liable for indirect losses, lost profits or lost data. Our total liability for a claim relating to a paid plan is limited to the amount you paid for it. Nothing here excludes liability or consumer rights that the law does not allow us to exclude.
Governing law and contact
These terms are governed by the laws of Israel. Mandatory consumer protections that apply where you live still apply. For questions, email support@phosphene.video or visit Contact.
